Disclaimer: I am not a lawyer and you should seek professional advice before making your decision.
Step 1 : Go to the USPTO website by clicking here (United States Patent & Trademark Office)
Step 2 : Navigate into Trademarks and click Search Trademarks
Step 3 : Click the TESS button
Step 4 : Navigate into Basic Word Mark Search (New User)
Step 5 : Type in the brand name that you are thinking about
In this example, we go through one brand name called “Sweese”. Note that this is a trademarked and one you should avoid, of course. After you type in a brand name in the field above, you can click into the “LIVE” link to learn more about that brand name and which class it represents. When you apply for a U.S. trademark, it’s important to identify the class of goods or services for which your trademark will be applied to. It’s important to choose the correct class and to describe the product you are selling. You will need to choose a class of goods when you register a trademark with the USPTO. Trademark classes are important because your trademark registration will only protect your trademark in the class that you’ve identified on your application. For example, if you are the owner of brand name as above “Sweese”, you won’t be protected if someone decides to use that brand for Footwear.
You can find a glossary of the classes here. (source: Legalzoom)
